WHEREAS, at a special meeting of the Mohave County Board of Supervisors held on December 8, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Jack and Bonita 1. Robertson of Payson, Utah, and WHEREAS, this property is located north of Interstate 15 and east of County Highway 91, northwest of the Virgin River in the Littlefield area. The site does not have proven access. The property has several buildings on it and is relatively flat, sloping slightly to the east toward the Virgin River. The surrounding land uses consist of vacant land and a few widely-scattered single-family residences. The Virgin River to the east is the only significant drainage pattern, and WHEREAS, the applicant requests this Zoning Use Permit for fowl auctions, recreational use, and the legal sport of cockfighting. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above,captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site does not have proven legal access. e. There are no significant enviromnental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 9, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: " . . . This Zoning Use Permit is for fowl auctions, recreational use, and the legal sport of cockfighting and activities related thereto. 2, The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits, 3. The Mohave County Public Works Department requests that adequate legal access to this site be provided by the applicant. 4, The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5, If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. TIlls Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, December 8, 1997, APPROVED this Zoning Use Permit as recommended by the Planning and Zoning Commission and as outlined herein, BE IT FURTHER RESOLVED, that: I.
