RESOLUTION NO. 97-345
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 32, RIO VISTA
RANCHES, TRACT 1229, IN SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A
SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE
SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
6,1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Leon R. and Pallia R. Barkley of Bullhead City, Arizona, and
WHEREAS, this property is located east of State Highway 95, between Camp Mohave Road and
EI Rodeo Road. The site is accessed from State Highway 95 via east on El Rodeo Road to La Riqueza Road,
then north on La Riqueza Road to the site, located on the west side approximately 150 feet south of
Panadero Road. The property has a single-family residence and several accessory buildings on it and is
relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist
of vacant lots and single-family residences. There are no significant drainage patterns noted, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R
(Agricllitural-Residential) zone. The applicants propose to convert a portion of the existing garage into a
studio apartment for their elderly parents. The Mohave County General Plan designates this area as an
Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone AO, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 10, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

I. This Zoning Use Permit is for a secondary residence on this property and the activities
related thereto. The floor area of the secondary residence may not be greater than one-half
the floor area of the primary residence.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regu1ations, Section 27.R (Accessory or Secondary Residence Requirements). A site plan
in accordance with Section 27.R must be completed and approved prior to approval of
permits.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circlliation in Kingman, Mohave County, Arizona, September 20,1997, and posted on September 19,1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their reglliar meeting
on Monday, October 6, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
