WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 6, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Lucy B. Schrader of To pock, Arizona, and WHEREAS, this property is located east ofthe Topock Highway (County Highway I) and north of Powell Lake Road. The site is accessed from Topock Highway (County Highway 1) via east on Powell Lake Road to Agua Caliente Drive, then north on Agua Caliente Drive to Ajo Place, then west on Ajo Place to the site, located at the western end of Ajo Place. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant lots and single-family residences to the north, east, and south, and to the west is an alley servicing several commercial establishments fronting on the Oatman- Topock Highway (Old US Highway 66). There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for "commercial use." The Mohave County General Plan designates this area as a Rural Development Area and Golden Shores is an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2805C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended but the use is not consistent with the surrounding land uses. d. The neighboring area contains other like"land uses similar to the above-proposed action only to the west across the alley. There is no direct access to the commercial area from this property. e. The site has legal access, but not from the Oatman- Topock Highway. f. There are no significant environmental features affecting the site. . . PAGE 2 OF 2 BK 297+ PG 95 FEE~9755+14 RESOLUTION NO. 97-344 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 10, 1997, the Commission recommended DENIAL for a Rezone based upon the following: 1. The use is not compatible with the surrounding neighborhood, as access to this property is by traveling on three residential streets and this property is at the end of a cul-de-sac. 2. This property does not have direct access to the Oatman- Topock Highway and the commercial area of Golden Shores. 3. This rezone will set a precedent for this area. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 20,1997, and posted on September 19,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 6,1997, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
