A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NOS. 95-494
AND 97-277 SETTING FORTH A REZONE AND AN EXTENSION OF TIME FOR A REZONE
OF PARCEL 45, LAZY YoU RANCH, PHASE I, AMENDED, IN TilE W~~ 8V/',~ SECTION 11,
TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R136A (AGRICULTURAL-RESIDENTIAL/
THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R18A (AGRICULTURAL-
RESIDENTIAL/EIGHT ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY
GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
2, 1997, a public hearing was conducted to determine whether an Amendment to BOS Resolution Nos. 95-
494 and 97-277, setting forth a Rezone and an Extension of Time for a Rezone, should be granted for the
above-described property as requested by the Mohave County Planning and Zoning Department, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been sffilek.

WHEREAS, this property is located southeast ofthe City of Kingman, south of Hualapai Mountain
Road. The site is accessed from Hualapai Mountain Road via southwest on Lazy YoU Drive to Tomahawk
Drive, then south on Tomahawk Drive to Buckboard Trail, then east on Buckboard Trail to Stallion Drive,
then south and east on Stallion Drive to the site. The property is vacant and mountainous. The surrounding
land uses consist of vacant property. There are several significant drainage patterns that cross the propertv,
The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, the Mohave County Planning and Zoning Department requests this Amendment to
BOS Resolution Nos. 95-494 and 97-277, setting forth a Rezone and an Extension of Time for a Rezone,
to correct a scrivener error made in the legal description on this property. The only change to both
resolutions is to delete "the Wy, SWW' from the legal description of the property; there are no
changes to the conditions of approval for the Rezone and the Extension of Time for the Rezone, and
WHEREAS, the applicant proposes this zone change to allow residential development. The
applicant proposes to divide the 40 acres into one 20-acre parcel and two 1 a-acre parcels. The Mohave
County General Plan designates this area as a Rural Development Area, and

WHEREAS, a review ofFEMA FIRM Panel #040058-2350C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County Genera] Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. The property has mountainous terrain and drainage ways but does appear to have buildable
sites for each lot.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 13, 1997, the Commission recommended APPROVAL for the Amendment to BaS Resolution Nos,
95-494 and 97-277 subject to the following:
NOTE: The only change to both resolutions is to delete "the Wy, SWv." from the legal description
of the property; there are no changes to the conditions of approval for the Rezone and the Extension
of Time for the Rezone.
The conditions of approval for the Rezone are as follows:
I. The north parcels will be zoned A-Rl8A (Agricultural-Residential/Eight Acre Minimum Lot
Sizes) and the south parcel will be zoned A-RlI5A (Agricultural-Residential/Fifteen Acre
Minimum Lot Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3. 16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
is required.
3, Centerline monumentation of the roadways will need to be provided to all changes to
direction and at all parcel boundaries. NOTE: Section 6.4-] I of the Mohave County
Subdivision and Road Maintenance Regulations states, "Road and street grades shall be
limited to a maximum of 16 percent (16%) for paved roadways and a maximum of 12
percent (12%) for thoroughfares and gravel roadways."
4. Adequate Ingress and Egress (I&E) and utility access will need to be provided to all
proposed parcels. Washes and drainage ways will not be blocked, Roadways that cross
washes or drainage ways shall meet Standard Detail No. 52 of the Mohave County Standard
Details or an engineer-approved alternative.

5. The roadway easement centerline will be monumented beneath the bladed road surface at all
easement angle points and coinciding parcel corners.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones,
9. The appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation. NOTE:
Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental
Health or ADEQ. Alternative waste treatment systems may be required for these lots.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisor
approval for the change in classification, as per ARS I I -829E.
I I. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension.
The conditions of approval for the Extension of Time for a Rezone are as follows:
I. Compliance with the conditions ofBOS Resolution No. 95-494,
2. This Extension of Time will be in effect until February 5, 1998.
WHEREAS, the notice of hcaring was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona. August] 6, 1997, and posted on August 15, 1997. as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 2,1997, APPROVED this Amendment to BOS Resolution Nos. 95-494 and 97-277
as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
