NW'I. OF SECTION 27, LYING WESTERLY OF US HIGHWAY 93, TOWNSHIP 16 NORTH, RANGE 13 WEST, FORA SELF-SERVICE FUELING FACILITY IN AN A (GENERAL) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Ronald G. Weber representing Woody's Enterprises, L TO, of Wick en burg, Arizona, and WHEREAS, this property is located on the west side of US Highway 93, in the Outlying Community of Wikieup. The site is accessed directly from US Highway 93 to the west and is located approximately three-tenths (0.3) of a mile south of Chicken Springs Road. The property is vacant and relatively flat, sloping slightly to the south. The surrounding land uses consist of vacant property, single- family residences and several roadside businesses. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a self~service fueling facility with aboveground fuel storage tanks. The Mohave County General Plan designates this area as a Rural Development Area and Wikieup is an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2913B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan, c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: . . . This Zoning Use Permit is for a self-service fueling facility with aboveground fuel storage tanks and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. Note: Site Plan is presently being reviewed by the Planning and Zoning Staff. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. Ifconstruction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16, 1997, and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
