AND THE Wy, OF SECTION 19, TOWNSHIP 23 NORTH, RANGE 19 WEST, FOR A PISTOL RANGE IN AN A- R/36A (AGRICULTURAL-RESIDENTIALITHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Earl V. and Dorothy B. Osborne of Palm Springs, California, and WHEREAS, this property is located approximately five and one-half (5Y,) miles west-southwest of the intersection of US Highway 93 and Chloride Road. The site is accessed from US Highway 93 via west on the AI Smith Mine Road, an undocumented roadway located approximately one and one-halfmiles north of Chloride Road, to the site. The property is vacant and rolling hills. The surrounding land uses consist of vacant Bureau of Land Management (BLM) land. There are no significant drainage patterns. and WHEREAS, the applicant requests this Zoning Use Permit to establish a firing range dedicated to firearm safety, training and education and for the sport of target shooting. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIR.M Panel #040058-2125C and #040058-l950B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department's records note that this property does not have adequate legal access. Adequate legal access to this parcel will have to be provided, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF 2 BK 2956 PG 233 FEE~97+8035 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a firing range and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction, including a detailed plot plan. 4, The applicant shall provide adequate permanent legal access to this parcel. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16,1997, and posted on August 15,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
