'NDEXEIJ 9748034 BK 2956 PG 230 OFFICIAL RECORDS OF MOHAVE COUNTY, A JOAN MC CALL, MOHAVE COUNTY RECORDEr 09/08/97 08:49A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-324 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 97-192 AND 97-193 WHICH APPROVED THE REZONE AND A ZONING USE PERMIT FOR THAT PORTION OF LOT 101 LYING SOUTHEASTERLY OF PIERCE FERRY ROAD, GATEWAY ACRES, TRACT 10, IN SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether approval should be granted for the Rescission of BOS Resolution Nos. 97-192 and 97-193 which approved the Rezone and Zoning Use Permit for the above-described property as requested by Kelly Kite, District Manager for Ferrellgas, Inc., of Kingman, Arizona, and WHEREAS, this property is located east of US Highway 93 and south of Pierce Ferry Road. The site is accessed from US Highway 93 via northeast on Pierce Ferry Road to the site, located on the southwest corner of Pierce Ferry Road and Bee Drive, fronting on Pierce Ferry Road. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of a convenience store and mini-mart to the north, a real estate office to the south, and several single-family residences to the east. The remaining property is vacant. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a Rezone to M-X (Heavy Manufacturing) by the Mohave County Board of Supervisors on June 2,1997, via BOS Resolution No. 97-192 and a Zoning Use Permit for a bulk propane tank on June 2, 1997 with BOS Resolution No. 97-193. Due to an oversight by Planning and Zoning, this property was rezoned and it did not meet the minimum lot size requirements for M-X (Heavy Manufacturing) zoning. The Mohave County General Plall designates this area as a Rural Development Area and Dolan Springs, four miles to the northeast, is an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site, 'I!F- . . PAGE 2 OF 2 BK 2956 PG 231 FEE~97+8034 RESOLUTION NO. 97-324 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended that BOS Resolution Nos. 97-192 and 97-193 be RESCINDED. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16,1997, and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED the Rescission ofBOS Resolution Nos. 97-192 and 97-193 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
