SEY. OF SECTION 22, LYING NORTHEASTERLY OF US HIGHWAY 93, TOWNSHIP 24 NORTH, RANGE 19 WEST, FOR A NO-KILL ANIMAL SHELTER, CLINIC, THRIFT STORE, TEACHING AREA AND PETTING ZOO IN AN A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above-described property as requested by Diana Moll of The Pet Protection Organization of Kingman, Kingman, Arizona, and WHEREAS, this property is located on the east side of US Highway 93, approximately four and one-quarter (4V.) miles north of Chloride Road, and the site is accessed directly from US Highway 93. The property is vacant and gently rolling hills, generally sloping slightly to the southwest. The surrounding land uses consist of vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests a Zoning Use Permit for an animal shelter, a petting zoo, a thrift store, and a low cost spay/neuter and shot clinic. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-1 975B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: ;.f ~ . . <- PAGE 2 OF 2 BK 2956 PG 225 FEE~97+8031 RESOLUTION NO. 97-321 Page 2 I. This Zoning Use Permit is for an animal shelter, a petting zoo, a thriti storc and a low cost spay/neuter and shot clinic. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16,1997, and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
