WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Worldcom Network Services, Inc., of Tulsa, Oklahoma, being represented by Mark Maslonka, Project Manager, Maslonka & Associates, Inc., of Phoenix, Arizona, and WHEREAS, this property is located west of Interstate 40 in the Yucca Townsite. The site is accessed from Interstate 40 via west at the Ford Proving Grounds exit to the Frontage Road, then south on the Frontage Road to Fourth Street, then south on Fourth Street to the site, located on the southwest comer of Fourth Street and Second Avenue. The property is vacant and relatively flat, sloping slightly to the south. The surrounding land uses consist of single-family residences and several neighborhood businesses along the Interstate 40 Frontage Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for the development of a Fiber Optic Regeneration Facility. The Mohave County General Plan designates this area as a Rural Development Area and Yucca is an Outlying Community, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on July 9, 1997, and was continued by the Commission because there were several questions asked by surrounding property owners that the staff could not answer and the applicant was not present, and WHEREAS, a review ofFEMA FIRM Panel #040058-2675B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains scattered single. family residences and a Citizens Communications facility. . . . PAGE 2 OF 2 BK 2956 PG 221 FEE~9748029 . RESOLUTION NO. 97-319 Page 2 e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a Fiber Optic Regeneration Facility and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. The six-foot fence around this property must meet the setback requirements of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4, If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16, 1997. and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
