A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 90-171
SETTING FORTH A REZONE OF LOTS 28, 29 AND 30 AND TIlE 8~~ OF LOT 28, BERMUDA
VILLAGE, IN SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM C-2 (GENERAL
COMMERCIAL) ZONE TO CoMO (COMMERCIAL-MANUFACTURING/OPEN LOT
STORAGE) ZONE, IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
2,1997, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 90-
171, setting forth a Rezone, should be granted for the above-described property as requested by Larry and
Kathleen Lively of Mohave Valley, Arizona, and
WHEREAS, the language to be added has been double underlined. Language to be deleted has been
stftlek, and
WHEREAS, this property is located south of Bullhead City and east of State Highway 95. The site
is accessed from State Highway 95 via southwest on Harbor Avenue to Barrackman Road, then south on
Barrackman Road to Village Drive, then west on Village Drive to Bermuda Court, then south approximately
100 feet to the site, located on the east side of Bermuda Court. The property has a commercial building on
it, outside storage and is relatively flat, sloping slightly to the southwest toward the Colorado River. The
surrounding land uses consist of vacant lots, several commercial businesses and single-family residences.
There are no significant drainage patterns, and
WHEREAS, the applicants request this Amendment to BOS Resolution No. 90-171, approving a
Rezone, to allow for the inclusion of the north half of Lot 28 in CoMO (Commercial-Manufacturing/Open
Lot Storage) zoning. The applicant has purchased the north half of Lot 28. The only change to the
resolution is to delete "and the Sv, of Lot 28" and add "Lot 28" to the legal description of the
property. There are no changes to the conditions of approval for the Rezone, and
WHEREAS, the Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review ofFEMA FIRM Panel #040058-2615C indicates the parcel described to be
in Zone B, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 13, 1997, the Commission recommended APPROVAL for an Amendment to BOS Resolution No.
90-171 subject to the following:
NOTE: The only change to the resolution is to delete "and the Sv, of Lot 28" and add "Lot 28" to the
legal description of the property; there are no changes to the conditions of approval for the Rezone.
The conditions of approval for the Rezone are as follows:
I. The applicant comply with all applicable provisions of Sections 25, 26, 27 and 31 of the
Mohave County Zoning Regulations.
2. Such storage shall be completely enclosed by a view-obscuring fence which extends two (2')
feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of
eight (8') feet in height. Such a fence shall display no advertising.
3. Any open lot storage must be related to or be an accessory to the primary business.
4. The applicant shall pave the driveway access and parking in accordance with Mohave
County Standard Specification #171, or better. The storage area shall be covered with a dust-
proof surface. If crushed rock is used for the dust-proof surface then the soil shall be
maintained in a weed free condition.
5. The applicant shall obtain a building permit.
6. Such zone change shall not be effective for at least thirty (30) days after final approval of the
change in zoning classification by the Board, being August 1, 1990, as per AR.S. 11-829E.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 16, 1997, and posted on August 15, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 2,1997, APPROVED this Amendment to BOS Resolution No. 90-171, setting forth
a Rezone, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
