MOHAVE COUNTY RECORDE' 09/08/97 08:43A PAGE 1 OF 2 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-307 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 3, BLOCK 5, COURTNEY GREENS II, FIRST AMENDED, TRACT 40S4-B, IN SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A MODEL HOME AND SALES OFFICE IN AN R-l (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by the Counsel Corporation Property Development, being represented by John K. Hoover, President, of Newport Beach, California, and WHEREAS, this property is located east of State Highway 95 between Camp Mohave Road and El Rodeo Road, south of Bullhead City. The site is accessed from State Highway 95 via east on Aztec Road to Aztec Place. Located on the north side approximately one-quarter mile east of State Highway 95, the property is located at the rear of Aztec Place. The property has a foundation for the house that is to be built on this property. The surrounding land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a model home and sales office. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 97-307 PAGE 2 OF 2 BK 2956 PG 193 FEE~97+8018 Page 2 '.' ~ . . 1. This Zoning Use Permit is for a model home and sales office in an R-I (Single Family Residential) zone and activities related thereto, including the selling of homes within the COURTNEY GREENS II and Aztec Villas subdivisions. No off-site sales will be allowed. 2. The house will be fully functional. When it is no longer being used as a sales office and model home it will be reconfigured to a single-family residence and garage, and will be inspected by the Mohave County Building Department for compliance with the building code. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has.been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16,1997, and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
