RESOLUTION NO. 97-306
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 21, RIO P ALMAS, UNIT
2-B, IN SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A SECONDARY
RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE
VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Jerrald K. and Gloria D. Downie of Burbank, California, and
WHEREAS, this property is located south of Bullhead City and east of State Highway 95. The site
is accessed from State Highway 95 via east on Valencia Road to Lynn Drive, then north on Lynn Drive to
Schiffer Road, then east on Schiffer Road to the site, located on the south side approximately 870 feet east
of Lynn Drive. The property has two mobile homes on it and is relatively flat, sloping slightly to the west
toward the Colorado River. The surrounding land uses consist of single-family residences and vacant lots.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R
(Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 13, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a mobile home as a secondary residence on this property and
the activities related thereto. The floor area of the secondary residence may not be greater
than one-half the floor area of the primary residence.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site
plan in accordance with Section 27.R must be completed and approved prior to approval of
permits.
3. This Zoning Use Permit will not become effective until the applicant applies for a building
permit for the room addition in order to meet the square foot requirements.
4. This Zoning Use Permit will not become effective until the applicant meets the Mohave
County Public Works Floodplain Department requirements.
5. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
6. If construction or use has not conunenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 16, 1997, and posted on August 15, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
\lOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
