MOHAVE COUNTY BOARD OF SUf'ERVISORS RECORDING FEE 0.00 ~ic=.~,;:-. . ,w.. , :.;r'~-- . :':j / "/ RESOLUTION NO. 97-304 A RESOLUTION SETTING FORTH A REZONE OF LOT 6, MOHA VE MESA, TRACT 1021, IN SECTION 27, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM C-2 (GENERAL COMMERCIAL) ZONE TO CoMO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Tim Pike of Pike's Collision Center and Towing, Fort Mohave, Arizona, and WHEREAS, this property is located south of Bullhead City and west of State Highway 95. The site is accessed directly from State Highway 95 and is located on the northwest corner of State Highway 95 and Gardena Road. The property has an automobile body shop on it and is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant lots and other general commercial businesses. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for outside storage in conjunction with the automobile service garage on this property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA F1RM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department recommends that the Arizona Department of Transportation (ADOT) should be contacted regarding the method of accessing State Highway 95, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. . . PAGE 2 OF 2 BK 2956 f'G IB9 FEH9748016 RESOLUTION NO. 97-304 Page 2 f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I. This property will be rezoned CoMO (Commercial-Manufacturing/Open Lot Storage). 2. The applicant shall provide a view. obscuring fence around the outside storage portion of this property. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16, 1997, and posted on August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
