A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1, BLOCK 1, BERMUDA
DUNES, TRACT 4039-A, IN SECTION 15, TOWNSillP 17 NORTH, RANGE 22 WEST, FOR AN
ON-SITE RESIDENT MANAGER'S LIVING QUARTERS IN A C-2H (GENERAL COMMERCIAL
HIGHWAY FRONTAGE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
3, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Paul R. La Bahn, Jr., of Chino Hills, California, and
WHEREAS, this property is located on the east side of Harbor Avenue, between Courtwright Road
and the Needles Bridge crossing the Colorado River. The site is accessed from State Highway 95, via
southwest on Harbor Avenue to the site, located on the northeast corner of Harbor Avenue and Empire Road.
The property has an existing boat storage facility on it and is relatively flat, sloping slightly to the south
toward the Colorado River. The surrounding land uses consist of general commercial businesses on either
side of Harbor Avenue to the west, and to the east there are single-family residences and vacant lots. There
are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for an on-site resident manager's living
quarters. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2615C indicates the parcel described to be
in Zone B, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 8, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

I. This Zoning Use Permit is for an on-site resident manager's living quarters and activities
related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. The existing Section 27.P (Site Plan Requirements) must be revised to show
the location of building and approved prior to approval of permits.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October IS, 1997, and posted on October 17, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
