A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 2 AS SHOWN ON
PARCEL PLATS BOOK 8, PAGE 44, IN SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST,
FOR A MODULAR SALES OFFICE IN A C-2H (GENERAL COMMERCIAL HIGHWAY
FRONT AGE) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regu1ar meeting of the Mohave County Board of Supervisors held on November
3, 1997, a public hearing was conducted to determine whether a Zoning Use Permit shou1d be granted for
the above-described property as requested by Merril Stubbs, L&M Equipment Company of Desert Springs/
Littlefield, Arizona, and
WHEREAS, this property is located south ofInterstate IS and west of the I-IS Farm Road Exit in
the Littlefield area. The site is accessed from Interstate IS via the Farm Road Exit to the Frontage Road,
then west on the Frontage Road to the site, located on the east corner of the Frontage Road and Desert
Springs Road. The property has an equipment rental company with a modu1ar office on it. The surrounding
land uses consist of a fire station to the southwest, the Desert Springs Ranchos, Tract 3029, subdivision to
the south, and vacant lots. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a modular sales office in a C-2H
(General Commercial Highway Frontage) zone. The Mohave County General Plan designates this area as
a Rural Development Area and an Outlying Community, and
WHEREAS, a review ofFEMA FIRM Panel #0400S8-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the
proposed Virgin River Communities Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 8, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

I. This Zoning Use Permit is for a modular sales office in a C-2H (General Commercial
Highway Frontage) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circlliation in Kingman, Mohave County, Arizona, October IS, 1997, and posted on October 17, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Reglliations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 3,1997, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
