MOHAVE COUNTY ORDINANCE NO. 2024-05
AN ORDINANCE SETTING FORTH AN AMENDMENT TO THE MOHAVE COUNTY
ZONING ORDINANCE SECTION 15 AGRICULTURAL RESIDENTIAL OR"A-R" ZONE, TO
ALLOW FOR THE SALE OF PRODUCE, EGGS, AND OTHER USES ASSOCIATED WITH
AGRICULTURE.
WHEREAS,at the regular meeting of the Mohave County Board of Supervisors held on Tuesday,
January 2, 2024, a public hearing was conducted to determine whether approval should be granted to
amend the Mohave County Zoning Ordinance Section 15,Regulations for Agricultural-Residential or"A-
R"Zone, and
WHEREAS, at the Board of Supervisors Meeting on October 16, 2023, staff was directed to
amend the Mohave County Zoning Ordinance to allow the sale of produce and other items related to
agriculture on the same site which the items were grown in the A-R zone. The request was made to allow
this use by right,without the need for a Special Use Permit, and
WHEREAS, this amendment is intended to allow for the sale of produce, eggs, and other uses
associated with agriculture on the same property on which the items were grown. This amendment does
not include the sale of marijuana, and
WHEREAS,staff proposes to require a site plan be approved in association with the sale of goods
when the site generates traffic in greater volume than would be expected in a residential area, and
WHEREAS,the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on December 13, 2023, the Commission recommended APPROVAL of this Amendment to the Mohave
County Zoning Ordinance, and
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, the Spectrum, a newspaper of general
circulation in the Arizona Strip Vicinity, Mohave County, Arizona the Mohave Valley Daily News, a
newspaper of general circulation in the South Mohave Valley vicinity, Mohave County, Arizona, and
MOHAVE COUNTY ORDINANCE NO. 2024-05 PAGE 2
Today's News-Herald, a newspaper of general circulation in the Lake Havasu vicinity, Mohave County,
Arizona, on December 13, 2023, and was posted on the Mohave County website on November 29, 2023
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT ORDAINED,that the Mohave County Board of Supervisors at their
regular meeting on Tuesday, January 2, 2024, ADOPTED this Ordinance to amend Section 15 of the
Mohave County Zoning Ordinance as follows (wording to be added is bolded and double underlined):

7. The sale of produce,eggs,and other goods associated with agriculture that are grown
on-site may be sold on that same property provided that the entrepreneur resides on
the property. The sale of goods are subject to Section 37.N Site Plan Requirements.
when the site generates substantial pedestrian or vehicular traffic in greater volumes
than would normally be expected in a residential area. The sale of marijuana is not
allowed as part of this use.
