A RESOLUTION SETTING FORTH A REZONE OF LOTS 17 AND 18, SUNHAVEN
HOMESITES, IN SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM C-2
(GENERAL COMMERCIAL) ZONE TO CoMO (COMMERCIAL-MANUFACTURING/OPEN
LOT STORAGE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regu1ar meeting of the Mohave County Board of Supervisors held on October
6, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the
above-described property as requested by Joseph N. and Donna R. Garrison of Tempe, Arizona, and
WHEREAS, this property is located northwest of State Highway 66, northeast of the City of
Kingman. The site is accessed from State Highway 66 via northwest on Diagonal Way to Able Drive, then
northeast on Able Drive to the site, located on the southeast side approximately 1,000 feet northeast of
Diagonal Way. The property is vacant and relatively flat, sloping slightly to the southeast. The surrounding
land uses consist of several general commercial businesses to the west along State Highway 66 and single-
family residences and vacant lots. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow a repair shop and warehouse with
outside storage. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 10, 1997, the Commission recommended APPROVAL for a Rezone subject to the following:

I. This property will be rezoned CoMO (Commercial-Manufacturing/Open Lot Storage).
2. The applicant will provide a view-obscuring fence around the open-lot storage portion of this
property.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
6. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedu1e a public hearing to grant an
extension, determine compliance with the schedu1e for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circu1ation in Kingman, Mohave County, Arizona, September 20,1997, and posted on September 19, 1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regu1ations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 6, 1997, DID NOT DENY OR APPROVE this Rezone based upon the following:
I. If twenty per cent (20%) of the property owners by area and number within the zoning area
file protests, an affirmative vote of three-fourths (3/4) of all members of the Board will be
required to approve the rezoning.
