WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 6,1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by James D. and Barbara A. Gardner of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Cactus Wren Drive to Jackrabbit Drive, then north on Jackrabbit Drive to the site, located on the east side approximately 350 feet north of Cactus Wren Drive. The property has a single-family residence along with several accessory buildings, a horse stable, and corral, and is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A- R/IOA (Agricultural-ResidentiallTen Acre Minimum Lot Size) zone for Barbara Gardner's mother. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 97-362 Page 2 . . . PAGE 2 OF 2 BK 2974 PG 147 FEE~9755432 I- ~ "-'""", WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 10, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a mobile home as a secondary residence on this property and the activities related thereto. The floor area of the secondary residence may not be greater than one-half the floor area of the primary residence. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements). A site plan in accordance with Section 27.R must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 20,1997, and posted on September 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 6, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
