It>lDEXED MICROFILMED 9767979 BK 3006 PG 471 OFFICIAL RECORDS OF MOHAVE COUNTY, A JOAN MC CALL, MOHAVE COUNTY RECORDER 12/18/97 01:22P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-449 EVALUATION OF A SUBDMSION FINAL PLAT FOR SUNLAKE VILLAGE, TRACT 3700-B, BEING A SUBDMSION OF A PORTION OF THE SOUTH HALF OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on December 15, 1997, a public hearing was conducted to determine whether the Pinal Plat should be approved for the above-referenced subdivision, and WHEREAS, the owner/developer of this tract is Sunlake Village, LLC. The engineer of record is A-N West, Inc., of Bullhead City, Arizona, and WHEREAS, the subdivision is located immediately north of Lake Havasu City. The property is accessed directly via State Highway 95, and west along and south of Lake Drive, and WHEREAS, the revised Preliminary Plan depicts 56 acres subdivided into 160 single-family residential lots and several parcels. The residential lots range in size from 7,500 to 13,230 square feet. A conditionally commercial parcel that had been included in Tract 3700 was administratively removed from the tract in 1996 to process separately, at the request of the developer, and WHEREAS, the Preliminary Plan for Sunlake Village, Tract 3700, was approved by the Mohave County Board of Supervisors on January 3, 1994, per BOS Resolution No. 94-3. A revised Preliminary Plan was conditionally approved by the Board on February 6, 1995, per BOS Resolution No. 95-30, and was given a new two-year period of approval. The Final Plat for Phase A of this subdivision was recorded on November 8, 1995. The as-built improvement plans for the improvements in Tract 3700-A were approved and all remaining assurances that had been posted for that phase were released to the developer by the Board on January 6, 1997, per BOS Resolution No. 97-2, and WHEREAS, the Final Plat and required documentation for Sunlake Village, Tract 3700-B, has been reviewed. The requirements of the Preliminary Plan, as outlined in the Mohave County Subdivision Regulations, appear to have been satisfied, and WHEREAS, the developer has proposed the use of a financial assurance document in the amount of the cost estimate approved by the Mohave County Public Works Department, being $116,831.15, as an assurance for the subdivision in its entirety, for the completion of all required improvements. The Chairman of the Board of Supervisors shall have the authority to approve the assurances submitted, if the cost estimate is revised and recommended for approval by the County Engineer and County Attorney's Office, and RESOLUTION NO. 97-449 Page 2 . . . PAGE 2 OF 2 BK 3006 PG 472 FEg9767979 WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, December 15, 1997, APPROVED the Final Plat for Sunlake Village, Tract 3700-B, subject to the following conditions: 1. A current title report (dated within 30 days of recordation) must be furnished to the Planning and Zoning Department prior to Final Plat recordation. 2. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as required for approval of this tract by the Board, and a final copy of the State Real Estate Report shall be submitted to the Planning and Zoning Department. 3. Lots within the recorded Final Plat of this development will not be further divided. 4. Any outstanding conditions set forth in BOS Resolution No. 95-30 shall be satisfied prior to the recordation of the Final Plat for Sunlake Village, Tract 3700-B. BE IT FURTHER RESOLVED, that a correct copy of all documents delineated above shall be submitted to Planning and Zoning for distribution and review. Upon receipt of evidence that these conditions have been met, together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County departments and officials and cause the Final Plat for Sunlake Village, Tract 3700-B, to be recorded.
