WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 1, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Alston Development, Inc., being represented by Chris E. Alston of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road, between Jagerson Avenue and Northern Avenue. The site is accessed from Stockton Hill Road via east on Jagerson Avenue to the site, located on the south side of Jagerson Avenue between North Van Nuys Road and North Bond Street. The property is vacant and relatively flat, sloping slightly to the east. The surrounding land uses consist of single-family residences and vacant lots to the south and east, a church to the west, and the Mohave Community College to the north. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for the proposed Alston Cerbat Ridge Subdivision, Unit II, Tract 3065. The applicant proposes to divide the 7.7 acres into 36 single-family residential lots with an approximate size of7,OOO square feet. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I. Parcel A, excluding the southern 300 feet, NEW KINGMAN ADDITION, Unit 11, Tract 1104, to be known and subdivided as ALSTON CERBAT RIDGE SUBDIVISION, Unit II, Tract 3065, will be rezoned R-O (Single Family ResidentiallMobile Homes Prohibited) as shown on Exhibit "A." 2. The rezone will be effective upon the recordation of the Final Plat of ALSTON CERBAT RIDGE SUBDIVISION, Unit II, Tract 3065, or until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 3. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 1, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
