A RESOLUTION SETTING FORTH A REZONE OF PARCEL 47C, AS SHOWN ON PARCEL
PLATS BOOK 11, PAGE 29, LAZY YoU RANCH, PHASE I, AMENDED, IN THE SEY- SEY- OF
SECTION 10, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/7A (AGRICULTURAL-
RESIDENTIAL/SEVEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/4A (AGRICULTURAL-
RESIDENTIALIFOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY
GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
I, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the
above-described property as requested by Robert 1. and Sandra R. Montgomery of Kingman, Arizona, and
WHEREAS, this property is located east of the City of Kingman and south of Hualapai Mountain
Road. The site is accessed from Hualapai Mountain Road via south and west on Lazy YoU Drive to
Tomahawk Drive, then southwesterly on Tomahawk Drive to Ranch House Drive, then southeasterly on
Ranch House Drive to Ranch House Lane, then northeasterly on Ranch House Lane approximately one- .
eighth mile to the west boundary of the property. The property is vacant. The terrain is rolling hills. The
surrounding land uses consist of vacant parcels, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
WHEREAS, the applicant requests this zone change to allow for the creation of an additional
building pad. The applicant proposes to divide the 9.636-net-acre parcel into two 4.8 I 8-net-acre parcels.
The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2350C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area. Additional comment from Mohave County
Floodplain: A wash crosses the parcel-- do not obstruct, and
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect does not comply with the Mohave County General Plan.
c. The site is adequate for the action intended; however, the use is not consistent with the
surrounding land uses.
d. The neighboring area does not contain other like land uses sirnilar to the above proposed
action, except for two parcels created prior to the March 10, 1995, adoption of the Mohave
County General Plan, which mandates a 5-acre minimum lot size in a Rural Development
Area.
e. The site has legal access.

f. There are no significant environmental features affecting the site, except the wash crossing
the parcel as noted above.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following:
I. These parcels will be rezoned A-R/4A (Agricultural-ResidentiallFour Acre Minimum Lot
Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
is required.
3. That the Board of Supervisors accepts the granting of 20-foot radius curves at the
intersection of the existing 30-foot Ingress and Egress (I&E) and Public Utility Easement
(PUE) with Ranch House Road. NOTE: Section 6.4-11 of the Mohave County Subdivision
and Road Maintenance Regulations states, "Road and street grades shall be limited to a
maximum of 16 percent (16%) for paved roadways and a maximum of 12 percent (12%) for
thoroughfares and gravel roadways."
4. The grantings required by the Rezone resolution shall be shown on the Parcel Plat.
5. The roadway easement centerline will be monumented beneath the bladed road surface at all
easement angle points and coinciding parcel corners.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal and public utility access.
8. The applicable flood zone(s) shall be noted on the parcel plat.
9. The appropriate zoning, building, environmental, and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation. NOTE:
Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental
Health or ADEQ. Alternative waste treatment systems may be required for these lots.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.

11. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisor's approval, this rezone approval will be
void. All other conditions are to be rnet upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and applicant who requested the rezoning) shall schedule a public hearing to grant
an extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 15,1997, and posted November 14, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December I, 1997, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
