NWV. OF SECTION 8, TOWNSffiP 20 NORTH, RANGE 14 WEST, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 1, 1997, a public hearing was conducted to determine whether an Abandonment should be granted for the above-described easements as requested by the owner, Mohave Group Land Development Co., represented by John Proffit, Mohave Engineering Associates, Kingman, Arizona, and WHEREAS, the site is east of Blake RanchlOdles Ranch Road and south ofInterstate 40. Access to the site is from 1-40, southwesterly on Blake Ranch Road to Old Highway 93, then south on Old Highway 93 to Odles Ranch Road, then further south on Odles Ranch Road to an unnamed Bureau of Land Management (BLM) access easement, approximately three and three-quarter miles from the Blake Ranch Road/I-40 intersection. The access easement proceeds one mile eastward to the site. The ingress/egress easements extend northward and eastward from this point (west quarter corner of Section 8) for one-quarter mile, and WHEREAS, the site is part of the preliminary plan for Mountain Shadow Estates, Tract 3806, a 54- lot subdivision proposed on the 160-acre site in the NWV. of Section 8. The owner proposes to abandon the easements to avoid the double-fronting of several lots in the new development. Legal access will be retained with the newly platted roadways in Tract 3806. The site is hilly and traversed by several dry washes. The easements are currently unoccupied. The General Plan specifies this site as a Suburban Development Area, and WHEREAS, Mohave Electric Cooperative and Citizens Utilities Company have reviewed the owner's petition and have no objection to the easement abandonment, and WHEREAS, the Department of Public Works does not object to the easement abandonment, and WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the easements described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: ,- , " . . The proposed action and effect comply with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surroundings and terrain. . d. The site has access via a 30-year renewable lease from the BLM. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL for the Abandonment subject to the following: I. The Final Plat for Mountain Shadow Estates, Tract 3806, must be recorded. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997 and November 22,1997, and posted November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December I, 1997, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
