OF SECTION 8, TOWNSHIP 20 NORTH, RANGE 14 WEST, TO BE KNOWN AND SUBDIVIDED AS MOUNTAIN SHADOW ESTATES, TRACT 3806, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO R-O/A/2A (SINGLE FAMILY RESIDENTIALIHOMES ONLY /LIMITED ANIMAL PRIVILEGESrrWO ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 1, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Mohave Group Land Development Company, being represented by Albert E. Brown of Flagstaff, Arizona, and WHEREAS, this property is located south of Interstate 40 and east of Blake Ranch Road. The site is accessed from Interstate 40 via southwest on Blake Ranch Road to "Old Highway 93", then south on "Old Highway 93" to Odles Ranch Road, then approximately one and three-eighths miles to an unnamed road, then east on this unnamed road approximately one mile to the southwest corner of the NWV. of Section 8. The property is vacant and the terrain is rolling hills with several major washes crossing the property, sloping generally to the southeast. The property has been surveyed and rough graded for the proposed roads. The surrounding land uses consist of vacant land with several scattered single-family residences to the south. There are several significant drainage patterns, and WHEREAS, the applicant requests this zone change for the proposed Mountain Shadow Estates, Tract 3806. The applicant proposes to divide the approximate 160.81 acres into 54 single-family residential lots ranging from 2.1 acres to 3.4 acres and three water well parcels. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. b. _.- . c. d. All notices have been advertised and posted according to regulations. The proposed action and the effect complies with the Mohave County General Plan. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area and the washes crossing the property. . ,,-.~ . . PAGE 2 OF 2 BK 3002 PG 440 FEE~9766448 RESOLUTION NO. 97-434 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The NWV. of Section 8, Township 20 North, Range 14 West, to be known and subdivided as MOUNTAIN SHADOW ESTATES, Tract 3806, will be rezoned R-O/A/2A (Single Family ResidentiallHomes OnlylLimited Animal PrivilegeslTwo Acre Minimum Lot Size). 2. The rezone will be effective upon the recordation of the Final Plat of MOUNTAIN SHADOW ESTATES, Tract 3806, or at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 3. The applicant shall provide permanent access to this property. 4. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December I, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
