RESOLUTION NO. 97-430
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THAT
PORTION OF LOT 74, LYING WESTERLY OF US HIGHWAY 93, IN GATEWAY ACRES,
TRACT 10, IN SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM A (GENERAL)
ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE
MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
I, 1997, a public hearing was conducted to determine whether an Extension of Time for a Rezone should
be granted for the above-described property as requested by William J. and Carolyn Sue Jones of Kingman,
Arizona, and
WHEREAS, this property is located on the west side of US Highway 93, approximately one-half
mile north of Pierce Ferry Road. The site is accessed to the west directly from US Highway 93. A tourist
souvenir shop/deli and a real estate office are located on the property. There are no significant drainage
patterns. The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on October 16, 1995 via BOS Resolution No. 95-371. The first Extension of Time was not requested by
the applicant, and
WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as
required by BOS Resolution No. 95-371, as stated in the applicant's letter dated September 22,1997, and
WHEREAS, this will be the first and second Extensions of Time for this property, and
WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.

f. There are no significant environmental features affecting the site.
g. This request complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 12, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone
subject to the following:
1. Compliance with the conditions ofBOS Resolution No. 95-371.
2. This Extension of Time will be in effect until October 16, 1998.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions ofBOS Resolution No. 95-371.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December I, 1997, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
