WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December I, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by GV Development, Inc., an Arizona Corporation of Golden Valley, Arizona, and WHEREAS, this property is located on both sides of State Highway 68 between Estrella Road and Egar Road. The site is accessed from State Highway 68 directly to the north and to the south, and is located approximately one-quarter mile west of Estrella Road. In addition, the property can be accessed from Chino Drive on the north side of the property. The property is vacant and slopes slightly to the southeast. The surrounding land uses consist of vacant land to the west and south. There is a real estate office located on the east side, south of State Highway 68, and several single-family residences located on the east side, north of State Highway 68. On the north side are scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for the development oflight industry. The applicant proposes to rezone the 300 feet along the frontage of State Highway 68 on the north and south sides as C-2H (General Commercial Highway Frontage) for service-oriented businesses. The remainder of the property north of State Highway 68 and the southern 925 feet would be rezoned to CoMO (Commercial- Manufacturing/Open Lot Storage) for light commercial-manufacturing businesses. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the property between the southern CoMO and C-2H zoned property is being requested to be rezoned M-X (Heavy Manufacturing) for a possible ice plant and electrical power station. The requested M-X zoning does not comply with the Mohave County General Plan and the surrounding uses for this area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and , . . All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I. The 300 feet adjacent to State Highway 68 on the north and south sides will be rezoned as C-2H (General Commercial Highway Frontage). The northern approximately 630 feet and the southern 1,125 feet will be rezoned to CoMO (Commercial-Manufacturing/Open Lot Storage) as shown on Exhibit "A." 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The applicant will contact and obtain a permit from the Arizona Department of Transportation (ADOT) for the method of accessing State Highway 68. 4. That the existing 200-foot roadway easement, known as State Highway 68, the 50-foot roadway easement, known as Chino Drive, and the 30-foot roadway easements, known as Eloy Road, Mahone Drive, and Emery Park Road, shall be dedicated to the public and accepted by the Mohave County Board of Supervisors as road rights-of-way. In addition, 20-foot radius curves are required at all dedicated roadway intersection points, except for intersections of county rights-of-way with State Highway 68 where 45-foot radius curves are required. 5. The eight feet adjoining to all rights-of-way, except for State Highway 68, shall be granted to the public as a Public Utility Easement (PUE). 6. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 7. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. . . . PAGE 3 OF 4 BK 3005 PG 318 FEE~9767551 RESOLUTION NO. 97-428 Page 3 8. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 9. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December I, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
