INDEXED MlCllOALMl:1J 9766440 BK 3002 PG 419 OFFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 12/09/97 04:02P PAGE 1 OF 2 MOHAVE COUNTY BOARO OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-425 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE EV, OF LOT 16, BLOCK A, FORT MOHA VE MESA RANCHOS, IN SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December I, 1997, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Dennis Gootrad of Westlake Village, California, and WHEREAS, this property is located south of Bullhead City, east of State Highway 95, between Joy Lane and EI Rodeo Road. The site is accessed from State Highway 95 via east on Joy Lane to the site, located on the northwest corner of Joy Lane and Calle Valle Vista. The property has a closed plant nursery on it and the terrain is relatively flat, sloping slightly to the west toward the Colorado River. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on October 2, 1995 via BOS Resolution No. 95-405. The first Extension of Time was not requested by the applicant, and WHEREAS, this Extension of Time will allow the applicant time to meet the remaining zone change conditions as required by BOS Resolution No.95-405, as stated in the applicant's letter of September 9, 1997,and WHEREAS, this will be the first and second Extensions of Time for this property, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. I ,." . PAGE 2 OF 2 BK 3002 PG 420 FEE~9766440 . RESOLUTION NO. 97-425 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the above noted Special Flood Hazard Area. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: I. Compliance with the conditions ofBOS Resolution No. 95-405. 2. This Extension of Time will be in effect until October 2, 1998. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions ofBOS Resolution No. 95-405, WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15,1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December I, 1997, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
