INDEXED , MICROflLMl:IJ 9766439 BK 3002 f'G 417 OFFICIAL RECORDS OF MOHAVE COUNTY, A JOAN MC CALL, MOHAVE COUNTY RECORDER 12/09/97 04'01P PAGE 1 OF 2 MOHAVE COUNTY BOARO OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-424 A RESOLUTION SETTING FORTH AN ACCEPTANCE OF AS-BUILT IMPROVEMENT PLANS AND RELEASE OF ALL REMAINING ASSURANCES FOR THE COMPLETION OF IMPROVEMENTS IN WILLOW VALLEY ESTATES, UNIT 20, TRACT 4134-A, BEING A SUBDIVISION OF A PORTION OF SECTION 21, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December I, 1997, a public hearing was conducted to determine whether As-Built Improvement Plans should be accepted and whether all remaining assurances for the above-described subdivision should be released as requested by the engineer of record, Burton Engineering, Inc., Bullhead City, Arizona, The owner/developer of this tract is McKellips Land Corporation of Phoenix, Arizona, and WHEREAS, the subdivision is located approximately eight miles south of Bullhead City. The site is accessed via State Highway 95, then west almost two miles along and north of King Street, and WHEREAS, the Preliminary Plan, conditionally approved by the Mohave County Board of Supervisors on March 9, 1992, per BOS Resolution No. 92-67, depicts 22 acres subdivided into SO single- family residential lots, a water well parcel and a number of open space parcels. The Final Plat for Willow Valley Estates, Unit 20, Tract 4134-A, was recorded on August 16, 1996, and WHEREAS, the As-Built Improvement Plans for this subdivision were conditionally approved by the Board of Supervisors on June 17, 1996, per BOS Resolution No. 96-105. A water tank had been constructed within the subdivision without the necessary zoning use permit. When the zoning use permit was requested after tank completion, the permit was denied for the location of the original construction. One condition of approval of the as-built plans per BOS Resolution No. 96-105 was the relocation of the water tank within ISO days to another site in the subdivision for which a zoning use permit had been approved. A financial assurance for the tank relocation to the approved site was also required. An Extension of Time allowing for the relocation of the water tank and securement of related state approvals was approved by the Board on February 3,1997, per BOS Resolution No. 97-35. A second Extension of Time was approved by the Board on August 4,1997, per BOS Resolution No. 97-266, and WHEREAS, staff has reviewed the As-Built Improvement Plans submitted for this subdivision. The County Engineer recommends acceptance of the As-Built Improvement Plans, and the release of all remaining assurances for this tract, and ~~ . . RESOLUTION NO. 97-424 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 12, 1997, the Commission recommended APPROVAL of the As-Built Improvement Plans and a release of all remaining assurances for the completion of improvements in Willow Valley Estates, Unit 20, Tract 4134-A, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 15, 1997, and posted on November 14, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December I, 1997, APPROVED this acceptance of the As-Built Improvement Plans and the release of all remaining assurances for Willow Valley Estates, Unit 20, Tract 4l34-A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
