RESOLUTION NO. 97-421
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A PORTION OF PARK PLACE,
ADJOINING LOTS 4 THROUGH 14, BEAVER DAM ESTATES, TRACT 3034-A, IN SECTION
5, TOWNSHIP 40 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHA VE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1998, a public hearing was conducted to determine whether an Abandonment should be granted for the
above-described roadway as requested by the owner, Keith Whittaker, represented by L.R. Pope Engineers,
Inc., St. George, Utah, and
WHEREAS, the site is north of Interstate 15 and east of Highway 91. Access to the site is from
Highway 91 onto Beaver Dam Road, located approximately three-quarter mile north of the I-IS/Highway
91 interchange. Park Place is the loop street accessing Beaver Dam Road, immediately east of Highway 91,
and
WHEREAS, the roadway is part of the Beaver Dam Estates subdivision, Tract 3034-A. The
roadway is parallel to the northeast bank of the Beaver Dam Wash. The owner proposes to abandon a
central portion of the roadway damaged and partly destroyed by a 1995 spring flood (see Exhibit A). The
abandoned roadway will equally accrue to the adjoining lots and Parcel B. Lots 4-14, 34-37 and Parcel B,
adjoining this portion of Park Place, will be abandoned and reverted to acreage in a concurrent action. The
remaining portions of the roadway will continue to serve the surviving lots. The General Plan specifies this
site as an Outlying Community in the Rural Development Area, and
WHEREAS, Rio Virgin Telephone and Cablevision has reviewed the owner's petition and requests
that they be compensated for labor, material, and engineering costs associated with relocating the existing
cable. A new improvement plan must also be provided to determine where the new cables will be placed,
and
,
WHEREAS, the Department of Public Works does not object to a conditional roadway
abandonment. Dixie Escalante Rural Electric Association does not object to the abandonment, and
WHEREAS, a review of FEMA FIRM Panel #040058-0025C indicates the roadway described to
be in Zone A, in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.
c. After a significant redesign, the site will be adequate for the action intended and the use will
be consistent with the surroundings and terrain.
d. The property adjoins to the Beaver Dam Wash and is subject to infrequent but heavy
flooding.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 12, 1997, the Commission recommended APPROVAL for the Abandonment subject to the
following:
I. For the damaged portion of Tract 3034-A, the owner will submit a new Preliminary Plan,
revised Drainage Report, and other associated documentation for review, possibly including,
but not limited to, the U.S. Corps of Engineer's 404 permit, Arizona Department of
Environmental Quality's (ADEQ) 401 permit, and an erosion protection proposal along the
bank of the Beaver Dam Wash.
2. A Final Plat developed from the new Preliminary Plan must be recorded.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 20, 1997 and the Kingman Daily Miner, a
newspaper of general circulation in Kingman, Mohave County, Arizona, December 28, 1997, and posted
December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, January 5, 1998, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
