RESOLUTION NO. 97-407
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE NORTHERN PORTION OF
SPRUCE LANE, ADJOINING LOTS 12, 13, AND 14, PINE LAKE, UNIT NO.3, IN THE NWV. OF
SECTION 28, TOWNSHIP 20 NORTH, RANGE 15 WEST, IN THE MOHAVE COUNTY
GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
3, 1997, a public hearing was conducted to determine whether an Abandonment should be granted for the
above-described roadway known as Spruce Lane as requested by an adjoining property owner Joseph Burns,
Pine Lake, Arizona, and
WHEREAS, the site is east ofHualapai Mountain Road, near the Hualapai Mountain Park. The site
is accessed from Hualapai Mountain Road, east on Knob Hill Drive approximately one-quarter mile to
Spruce Lane. The roadway begins at its intersection with Knob Hill Drive and extends northward
approximately 150 feet, at a moderate incline, where it dead-ends, and
WHEREAS, the owner proposes the partial roadway abandonment to allow for the proper placement
of an on-site septic system based on ADEQ Bulletin No. 12. The northern portion of Spruce Lane appears
to be only used by the neighbors on either side of the road. The abandonment may lessen access to the
adjoining land owner to the north. The Mohave County General Plan designates Pine Lake as an Outlying
Community in a Rural Development Area, and
WHEREAS, the Mohave County Public Works Department, Bureau of Land Management, Mohave
Electric Cooperative, and Citizens Utilities Company have reviewed the owner's petition and have no
objection to the roadway abandonment, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2507B indicates the road described to be in
Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan,
c. The site is adequate for the action intended and the use is consistent with the surroundings
and terrain.
d. The roadway is currently unoccupied.

e. The site has legal access.
f. The site has no significant environmental features.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 8, 1997, the Commission recommended APPROVAL for the Abandonment subject to the
following:
I. The eastern 24 feet of Spruce Lane will accrue to Lots 13 and 14.
2. Charles A. Cox and/or Coralee F. Cox, trustees of The Cox Family Trust, will sign an
agreement as Trustee(s) accepting the western 16 feet of Spruce Lane, in lieu of the western
20 feet of Spruce Lane.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 18, 1997, and October 25, 1997, and posted
October 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 3,1997, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
