" . ~; RESOLUTION NO. 97-406 A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE WESTERN 588.77 FEET OF AGATE DRIVE, AS MEASURED ALONG THE NORTH RIGHT -OF -WAY LINE, AS SHOWN IN PARCEL PLATS, BOOK 2, PAGE 93, IN THE Wv, OF SECTION 17, TOWNSHIP 20 NORTH, RANGE 13 WEST, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 3,1997, a public hearing was conducted to determine whether an Abandonment should be granted for the above-described roadway known as Agate Drive as requested by the adjoining property owner, Silver Ranch Corporation, represented by Michael Horner, Kingman, Arizona, and WHEREAS, the site is west of US Highway 93 and south ofInterstate 40. The site is accessed from the US Highway 93/01d Highway 93 intersection. The roadway begins approximately one and one-half miles northwest of the intersection and extends eastward approximately 590 feet, and WHEREAS, the owner proposes the partial roadway abandonment to allow for the recordation of the Final Plat for Silverado Acre Estates, Unit I, Tract 3805. Agate Drive will be rededicated with a different alignment to accommodate the new lot layout and improved intersection design of the subdivision. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, Mohave Electric Cooperative and Citizens Utilities Company have reviewed the owner's petition and have no objection to the roadway abandonment, and WHEREAS, the Department of Public Works recommends conditional approval of the abandonment, and WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the road described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surroundings and terrain. " . . PAGE 2 OF 2 BK 2987 PG 635 FEE~9760569 Page 2 RESOLUTION NO. 97-406 d. The roadway is currently unoccupied and the site has legal access. e. The site has gently rolling terrain and numerous small washes. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 8, 1997, the Commission recommended APPROVAL for the Abandonment subject to the following: I. The road abandonment will accrue equally to adjoining lots and will not become effective until the recordation of the Final Plat for Silverado Acre Estates, Unit I, Tract 3S05. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October IS, 1997, and October 25, 1997, and posted October 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 3,1997, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
