OF SECTION 31, TOWNSHIP 15 NORTH, RANGE 17 WEST, FOR AN AUTOMOBILE TEST TRACK IN AN M-X (HEAVY MANUFACTURING) ZONE, IN THE YUCCA PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 3, 1997, a public hearing was conducted to determine whether approval should be granted for a Specific Use Permit for the above-described property as requested by Randy Lyles of Temecula, California, being represented by William J. Roper of Kingman, Arizona, and WHEREAS, this property is located south of Alamo Road and southeast of Interstate 40 in the Yucca area. The site is accessed from Interstate 40 via the Alamo Road Exit, to the east side of Interstate 40, then south, east, and southeast on Alamo Road approximately 4.5 miles to Ray Road, then south on Ray Road approximately two miles to Oscar Drive, then east on Oscar Drive approximately one-eighth mile to the continuation of Ray Road following the section line between Township 17 West and Township 18 West, then south on Ray Road to the site, located approximately 15 miles south of Oscar Drive. The property is vacant and relatively flat, sloping slightly to the northeast. The surrounding land uses consist of vacant (BLM) and railroad land. There are several significant drainage patterns crossing the property from the southwest to the northeast, and WHEREAS, the applicant requests this Specific Use Permit to allow for an asphalt-paved automobile test track. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on July 9, 1997, and was continued by the applicant and staff due to several administrative errors, and WHEREAS, a review ofFEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional comments from the Mohave County Flood Control District: There are washes crossing this parcel-DO NOT BLOCK, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. RESOUJTION NO. 97-403 Page 2 . '~ . . PAGE 2 OF 2 BK 2987 PG 628 FEE~9760566 c. The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 8, 1997, the Commission recommended APPROVAL for a Specific Use Permit on the SWY< of Section 31, Township 15 North, Range 17 West, subject to the following: I. This Specific Use Permit is intended for an asphalt-paved automobile test track in an M-X (Heavy Manufacturing) zone and activities related thereto; any new use will require another Specific Use Permit. 2. The Specific Use Permit will commence upon the effective date of the rezone. 3. Approval of a Specific Use Permit with such conditions and restrictions as the Board of Supervisors may impose, shall be valid for two (2) years, in which time construction on the project shall commence or the use authorized shall be initiated. Prior to expiration of the approval, the developer may request an Extension of Time from the Commission to initiate the project, and the Commission shall recommend to the Board an action based upon a finding of substantial grounds of which to grant such an Extension of Time up to one (I) year. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 18,1997, and posted on October 17,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 3, 1997, APPROVED this Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
