BEALE STREET 3an FLOOR KINGMAN, AZ 86401 MOHAVE COUNTY ORDINANCE NO. 2023-04 AN ORDINANCE SETTING FORTH AN AMENDMENT TO THE MOHAVE COUNTY ZONING ORDINANCE, SECTION 37.1) LOCATION OF ACCESSORY BUILDINGS, TO ALLOW THE PLACEMENT OF METAL STORAGE CONTAINERS, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, August 14, 2023, a public hearing was conducted to determine whether approval should be granted for an Amendment to The Mohave County Zoning Ordinance, Section 37.1), Location of Accessory Buildings, as requested by Mohave County, and WHEREAS, currently, metal storage containers may be placed on a parcel within Mohave County with the necessary permits and must comply with Section 37.0 Open Lot Storage Standards. Surrounding jurisdictions allow metal storage containers separate of open lot storage. The containers are instead allowed as accessory structures, and I WHEREAS,the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect does comply with the Mohave County General Plan. WHEREAS, at the public hearing held before the Mohave County Planning and Zoning Commission on June 14,2023,the Commission recommended APPROVAL of this Amendment, and WHEREAS,the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, the Spectrum, a newspaper of general circulation in the Arizona Strip Vicinity, Mohave County, Arizona the Mohave Valley Daily News, a newspaper of general circulation in the South Mohave Valley vicinity, Mohave County, Arizona, and Today's News-Herald, a newspaper of general circulation in the Lake Havasu vicinity,Mohave County, Arizona, on June 18, 2023, and was posted on the Mohave County website on June 18, 2023 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. BOS ORDINANCE 2023-04 PAGE 2 NOW THEREFORE BE IT RESOLVED,that the Board of Supervisors, at their regular meeting on Monday, August 14, 2023, ADOPTED this Ordinance to amend Section 37.1),Location of Accessory Buildings—General Provisions as outlined herein(wording to be added has been bolded and double-underlined. The wording to be deleted has been struck): 5. Metal Storage Containers (Cargo Containersl a. Shall be independent of any trailers or axels and does not include tractor-trailers or boxcars. b. May be placed on all residential and commercial zones in the same manner as an accessory structure. c. Shall not count towards Section 37.0 Open Lot Storage Standards but shall count towards maximum allowed lot coverage. d. Utilities or occupancy shall require all necessary permits.
