RESOLUTION NO. 98-100
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THAT
PORTION OF THE SE¼ SE¼ OF SECTION 5, LYING NORTHERLY OF THE
NORTHWESTERLY RIGHT-OF-WAY LINE OF INTERSTATE 15, IN TOWNSHIP 40 NORTH,
RANGE 15 WEST, FROM A (GENERAL) ZONE TO C-2H/3A (GENERAL COMMERCIAL
HIGHWAY FRONTAGE/THREE ACRE MINIMUM LOT SIZE) ZONE, IN THE ARIZONA
STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above-described property, as requested by William W. and Joann I. Wall of Beaver Dam,
Arizona, and
WHEREAS, this property is located northwest of the 1-15/Littlefield Interchange. The site is
accessed from the 1-15 West Frontage Road south to the property. The property is located on the west side
of the Frontage Road, and is vacant. There are no significant drainage patterns. The Mohave County
General Plan designates this area as a Rural Development Area and Littlefield/Beaver Dam is considered
an Outlying Community. The rezone conforms to the proposed Virgin River Communities Area Plan, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on March 10, 1995, via BOS Resolution No. 95-79. The first and second Extensions of Time were granted
on February 2, 1998, with BOS Resolution No. 98-45, and
WHEREAS, this Extension of Time will allow the applicant to complete the conditions as required
by BOS Resolution No. 95-79. The applicant stated in his letter of January 7, 1998, that he is currently
working out the details for utility infrastructure improvements as well as access of County Highway 91 in
conjunction with the adjacent Walott parcel. As soon as the final details are worked out with ADOT, he will
be in a position to file a parcel plat for the property, and
WHEREAS, this will be the third Extension of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
g. This request complies with the Extension of Time Policy as the applicant is in the process
of getting access on County Highway 91.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission reconn~ended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Compliance with the conditions of BOS Resolution No. 95-79.
2. This Extension of Time will be in effect until March 10, 1999.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution No. 95-79.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
