RESOLUTION NO. 98-101
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A
PORTION OF THE SE¼ OF SECTION 34, TOWNSHIP 41 NORTH, RANGE 15 WEST AND A
PORTION OF THE N~ OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM R-
E/10A (RESIDENTIAL-RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE TO C-RE
(COMMERCIAL-RECREATION) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above-described property as requested by William L. Gates and John Johnson, dba Virgin
River AZ, of Littlefield, Arizona, and
WHEREAS, this property is located north of Interstate 15 and east of the I-15 Farm Road Exit in
the Littlefield area. The site is accessed from Interstate 15, via the 1-15 Farm Road Exit to the Frontage
Road, then northeast on the Frontage Road to the site, located on the north side of the road. The property
is vacant and relatively flat, sloping slightly to the north and west toward the Virgin River. There are several
significant drainage patterns crossing the property, mostly along the northern part toward the Virgin River.
The Mohave County General Plan designates this area as a Rural Development Area and an Outlying
Community. The rezone conforms to the proposed Virgin River Communities Area Plan, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on August 7, 1995 via BOS Resolution No. 95-313. It was extended for the first time with BO S Resolution
No. 96-361 on November 4, 1996, and
WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as
required by BOS Resolution No. 95-313, and
WHEREAS, the property owner has accomplished the Drainage Study, the Traffic Impact Analysis
and has submitted their wastewater treatment plans to the Arizona Department of Environmental Quality
(ADEQ) and are awaiting approval, as required by the conditions of approval for BOS Resolution No. 95-
313 and as noted in his letter of February 3, 1998, and
WHEREAS, this will be the second Extension of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Ama, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
g. This request complies with the Extension of Time Policy.
Wtt~REAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Compliance with the conditions of BOS Resolution No. 95-313.
2. This Extension of Time will be in effect until August 7, 1998.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution No. 95-313.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, APPROVED this Extension of Time for a Rezone as recommended by the
