OF 2 ~IOHAVE COUNTY 80AR[) OF SUPERV);SORS RECORDING FEE ;%)] RESOLUTION NO. 98-106 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE S~ SW¼ NW¼ OF SECTION 13, EXCEPT FOR THE INTERSTATE 40 AND STATE HIGHWAY 95 RIGHTS-OF-WAY, IN TOWNSHIP 16 NORTH, RANGE 20 WEST, FOR FOUR 30,000-GALLON ABOVEGROUND DIESEL FUEL STORAGE TANKS IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on April 20, 1998, a public heating was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by the Piiot Corporation being represented by Edward E. Rowell, Project Development Manager. The Pilot Corporation is located in Knoxville, Tennessee, and WHEREAS, this property is located on the southeast comer of the intersection of Interstate 40 and State Highway 95 and is accessed directly from State Highway 95 to the east. The property is vacant and the terrain is gently rolling hills, sloping slightly to the west. The surrounding land uses consist of vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for four 30,000-gallon aboveground diesel fuel storage tanks in a C-2H (General Commercial Highway Frontage) zone in support of the Pilot Corporation's travel center. The Mohave County General Plan designates this area as a Rural Development Area. This property was rezoned to C-2H (General Commercial Highway Frontage) on August 4, 1997 via BOS Resolntion No. 97-283, and WHEREAS, a review of FEMA FIRM Panel #040058-2805C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-106 Page 2 1. This Zoning Use Permit is for four 30,000-gallon aboveground diesel fuel storage tanks in a C-2H (General Commercial Highway Frontage) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The applicant will comply with all the requirements of the State Fire Marshal's Office and the local fire department. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, April 20, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
