RESOLUTION NO. 98-109
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF SUNSET RANCHOS II, TRACT 4156, BEING A
SUBDIVISION OF A PORTION OF SECTION 13, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN
THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time as requested by the developer/agent, Dan Oehler, Bullhead City, Arizona. The project engineer of
record is Burton Engineering, Inc., Las Vegas, Nevada, and
WHEREAS, the subdivision is located approximately one-half mile southeast of Bullhead City.
The property is accessed via State Highway 95, then east one mile along Camp Mohave Road, then north
over one-half mile along Mountain View Road, then east along Sundance Road to the site, and
WHEREAS, the Preliminary Plan depicts 12.5 acres subdivided into 22 single-family residential
lots, with a minimum lot size o£21,780 square feet. This development is a subdivision of Lots 10 and 1 l,
Block 8; Lots 7 through 12, Block 14; Lots 6 and 7, Block 9; and Lot 7, Block 11, of existing Sunset
Ranchos, Tract 4046-B, and
WHEREAS, the developer/agent has indicated in a letter dated December 23, 1997, that an
Extension of Time is being requested in order for the developer and his project engineer to obtain an
approval of sanitary facilities from the Arizona Department of Environmental Quality to allow for the use
of individual septic systems on the lots in the subdivision. The developer has submitted some
documentation to show that his engineer has made contact with ADEQ regarding this issue. The
developer/agent also states that "significant work has been completed toward finalizing this project and it
is definitely the intention of the developer to obtain the remaining necessary approval and complete the
project." No as-built improvement plans or engineer-certified statement for the completion of any
improvements in this subdivision has been received by Mohave County, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on January 2, 1996, per BOS Resolution No. 96-11. Subdivision Regulation Article 3.10-1
states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in
increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively
processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be
temfinated.", and

WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this will be the first Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. Though this subdivision has not actively processed in the past year, the request for a first
Extension of Time of this Preliminary Plan complies with the Extension of Time Policy in
that the developer and his engineer appear (through the documents submitted by the
developer with this request) to be making an effort to resolve with ADEQ the issue of
individual septic system use for the lots in the subdivision.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recon~nended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution No. 96-11.
2. If during the development of this project it is determined that the use of septic systems within
this subdivision is not acceptable to the Arizona Department of Enviroun~ental Quality or the
Mohave County Environmental Health Division, the subdivision may have to be redesigned.
Such redesign may require an amendment to the Preliminary Plan approval or the submittal
of a new Preliminary Plan or Sketch Plan.
3. This Extension of Time will be in effect until January 2, 1999.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
