A RESOLUTION SETTING FORTH A REZONE OF LOT 17, RAINBOW ACRES, REPLAT, IN
SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM C-2 (GENERAL
COMMERCIAL) ZONE TO C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT
STORAGE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Roy Treffke, dba Rainbow Buggy Center, of Fort Mojave, Arizona, and
WHEREAS, this property is located east of State Highway 95 between Camp Mohave Road and
E1 Rodeo Road. The site is accessed from State Highway 95 via east on Camino Colorado to Calle E1
Dorado (North), then north on Calle El Dorado (North) to the site, located on the west side approximately
150 feet north of Canrino Colorado. The property has an auto repair shop and a single-family residence on
it and is flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of
other general commercial businesses to the west along State Highway 95, vacant lots, and single-family
residences to the east. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for storing vehicles and automobile
parts outside. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel//040058-2445C indicates the parcel described to be
in Zone AO, in the Special Flood Hazard Area, and
WHEREAS, Lots 11 thru 22 are zoned C-2 (General Commercial) or C-2H (General Commemial
Highway Frontage), Lots 23 thru 64 are zoned SD/RM (Special Development/Multiple-Residential) and
Lots 65 thru 190 are zoned SD/R-1 (Special Development/Single Family Residential), and
WHEREAS, this rezone action is to correct a violation of the Mohave County Zoning Regulations,
and
WHEREAS, this item was first heard at the Plmming and Zoning Commission meeting on January
14, 1998, and was continued by the Commission since the applicant was not present to answer questions,
and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Comntission on
March t 1, 1998, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned C-MO (Commercial-Manufacturing/Open Lot Storage).
2. The applicant will provide a view-obscuring fence around the open lot storage portion of this
property.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
6. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, ! 998, APPROVED this Rezone as recommended by the Mohave County Pla~ing and
Zoning Commission and outlined herein.
