HomeMy WebLinkAbout98-114 Q9~C}~_0~,_~5 I~.K 3066 OFFICiAl_ RECORDS OF MOHAkCE ?tAN MO C~LL~ ~OFIAVE MOHAVE COUNTY ~,OARD OF" ~:ECOROIN6 FEE % ]0 RESOLUTION NO. 98-114 A RESOLUTION SETTING FORTH A REZONE OF THE SE¼ NE¼ OF SECTION 22, AND THAT PORTION OF THE NE¼ SE¼ OF SECTION 22 LYING NORTHERLY OF AZTEC ROAD, EXCLUDING THE 50-FOOT RIGHT-OF-WAY FOR STATE HIGHWAY 95 ALONG THE EASTERN BOUNDARY AND THE NORTH 248.16 FEET OF THE EAST 302.00 FEET, IN TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to detemfine whether approval should be granted to Rezone the above- described property as requested by Transworld Real Estate and Investment of Mesa, Arizona, and WHEREAS, this property is located west of State Highway 95 between Aztec Road and Camp Mohave Road. The site is accessed directly fi~om State Highway 95 and is located on the northwest corner of State Highway 95 and Aztec Road. The property is vacant and the terrain is gently rolling hills, sloping slightly to the ~vest toward the Colorado River. The surrounding land uses consist of the Safeway Shopping Center to the south and numerous businesses on both sides of State Highway 95. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for commercial development. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone AO, one-foot depth, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAgE 2 OF 2 5K [~066 Pg 6'71 FEE;~?St)201.25 RESOLUTION NO. 98-114 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-2 (General Commercial). 2. The applicant will obtain concurrence from the Arizona Department of Transportation (ADOT) for the proposed method of accessing State Highway 95. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. If this property is divided, a parcel plat will be required to be submitted. 4. The appropriate zoning, building, environmenial, and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Rezone as recommended by the Mohave County Planning and Zoniru~ammission and outlined herein. ~$x~~'_~.
