HomeMy WebLinkAbout98-116 OFFICIAL RECORDS OF MOHAVE (:OUNiY~ JOAN MC CALL~ MOHAVE COUNTY RECORDER D4/OB/gB 02:14P PAGE 1 OF 2 ~IOHAVE COUNTY BOARD OF SUF'ER~]~SORS RECOROING FEE RESOLUTION NO. 98-116 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF LOTS 3 AND 4, EXCEPT THE NORTHERLY 135 FEET, BLOCK H, GOLDEN SAGE RANCHOS, UNIT 57, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL- RESIDENTIAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE), IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on .&pill 6, 199R, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Mohammad Imtiaz and Shahnaz K. Ahmad of Kingman, Arizona, and WHEREAS, this property is located on the north side of State Highway 68, between Tooman Road and Bryce Road. The site is accessed directly from State Highway 68. The property is vacant and relatively flat, sloping slightly to the southwest. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on December 2, 1996, via BOS Resolution No. 96-414, and WHEREAS, this Extension of Time will allow the applicant time to complete his plans for starting a small business, which have been delayed due to unforeseen circumstances and financial reasons, and the other conditions as required by BO S Resolution No. 96-414, and WHEREAS, in his letter dated December 12, 1997, the property owner requested a two-year Extension of Time and that Condition of Approval Number 6 be eliminated. The normal Extension of Time policy period is one year and Condition Number 6 is required by state law, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 96-414, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and F'FiGE 2 OF 2 ~J~,.~ F'G ,57!5 FEE:::?8' 2]L2':z RESOLUTION NO. 98-116 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. Them are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conmfission on March 11, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 96-414. 2. This Extension of Time will be in effect until December 2, 1998. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions of BOS Resolution No. 96-414. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Extension of Time for a Rezone as recommended by the Mohave..~.~.gnty Planning and Zoning Commission and outlined herein. ~_,~-~,'o.~,'"~ ~q~4~ ~ MOHAVE COUNTY BOARD OF SUPERVISORS ~t, "?~-9~ .
