HomeMy WebLinkAbout98-118 OFFICIAL RECORDS OF MOHAVE COUN!T:' JOAN MC CALL~ MOHAVE COUNTY RECORDER ' ~' ~4/08I~8 02:15F' PAGE MOH6VE CQUNI'Y BOARD OF ~ REC9F:D ZNG FEE RESOLUTION NO. 98-118 A RESOLUTION SETTING FORTH AN AMENDMENT OF THE SACRAMENTO VALLEY (GOLDEN VALLEY) AREA PLAN, AS AMENDED, ORIGINALLY ADOPTED APRIL 7, 1980, TO PROVIDE FOR A CHANGE IN THE LAND USE DESIGNATION FOR THE NE¼ NE¼ OF SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-R (AGRICULTURAL- RESIDENTIAL) TO C (COMMERCIAL), IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether approval should be granted to amend the Sacramento Valley (Golden Valley) Area Plan to allow for commercial development on the above- described property as requested by Tommie Recco and Priscilla Moker Robertson of Moline, Illinois, being represented by Robert A. Leblanc of Kingman, Arizona, and WHEREAS, this property is located north of State Highway 68 between Aztec Road and Adobe Road. The site is accessed from State Highway 68 via north on Aztec Road to the site, located on the southwest comer of Aztec Road and Chino Drive. The property is vacant and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant land and several scattered single-family residences. The eastem fork of the "Thirteen Mile Wash" crosses the southeast comer of the property, and WHEREAS, the Planning and Zoning Commission is required by state law to recommend to the Board of Supervisors a General Plan or Area Plans which recommend conserving natural resources, ensure efficient expenditure of public funds, and promote the health, safety, and convenience, and general welfare of the public, and WHEREAS, the Sacramento Valley Area Plan was adopted on April 7, 1980, via BOS Resolution No. 1457. This was in response to the Board of Supervisors desire to revise Mohave County's original General Plan, adopted in 1965, to provide Master Plans for each of the nine (9)newly-established study areas, of which the Sacramento Valley was included and is a discrete part. Since that time, the Area Plan has been revised 18 times. Ten of these revisions involved the insertion of new commercial uses ranging from 1.3 acres to 600 acres in size. The Sacramento Valley Area Plan has not been revised since September 1992. The proposal will convert approximately 40 acres from its current A-R (Agricultural-Residential) land use designation to a C (Commercial) land use designation, and E,K 7u6d~ P(-: ,57° RESOLUTION NO. 98-118 Page 2 WHEREAS, this site will be served by the Golden Valley Fire Department. Electricity will be supplied by Citizens Utilities. Adequate fire flows (water) can be provided by the Valley Pioneer Water Company with the extension of the existing 12" diameter line located at the comer of Aztec Road and Chino Drive. Access roads to the site are currently bladed and maintained to the County's native material standard. Traffic counts for the Aztec Road/Chino Drive intersection totaled more than 800 trips per day in 1994. A shopping center of 50,000 square feet is estimated to generate 4,600 trips per day based on Table 820 of Institute of Transportation Engineers' manual of Trip Generation, 5th ed. Approximately 75% of these trips will pass through the Aztec Road/Chino Drive intersection. The increased traffic loads caused by this development will necessitate the improving of these roads to a paved standard and shall be a condition of the companion rezone, and WHEREAS, a review of the FEMA FIRM Panel #040058-2325B indicates that a portion of the parcel described to be in Zone A, the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. Individual notification letters were mailed to property owners whose land holdings are bounded by State Highway 68 to the south, Burro Drive to the north, Hope Road on the east and Amado Road on the west. c. The notification area is comprised of approximately 621 acres of land divided into 235 tax parcels and held by 197 owners. Seventy-seven (77) parcels possess some type of improvement, mostly residential in nature. The remaining 158 parcels are vacant. Commercial uses in the notification area are located along State Highway 68, east of Aztec Road. d. The proposed action and effect complies with the Mohave County General Plan regarding the type of development expected within an Urban Development Area. e. The southern boundary of this site adjoins a C (Conunercial) land use as designated by the Sacramento Valley Area Plan. f. The site is adequate for the action intended and the use is consistent with the surrounding terrain. g. The site has legal access. h. There are no significant environmental features affecting the site other than the above mentioned FEMA Special Flood Hazard Area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for the Amendment subject to the following: 1. The conditions of the companion Rezone will be met prior to the revision of the Sacranrento Valley (Golden Valley) Area Plan changing the NE¼ NE¼ of Section 10, Township 21 North, Range 18 West from the existing A-R (Agricultural-Residential) land use designation to the proposed C (Commercial) land use designation. RESOLUTION NO. 98-118 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
