WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to deten~ine whether a Zoning Use Permit should be granted for the above-described property as requested by Valley Pioneer Water Company, Inc., being represented by John Clayton, General Manager, of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68, between Colorado Road and Verde Road. The site is accessed from State Highway 68 via north on Colorado Road to the site, located on the southeast comer of Colorado Road and Ch/no Drive. The property is an existing well site. The surrounding land uses consist of single-family residences and vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a water company office and shop building in an A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the Mohave County Public Works Department recommends that the existing 35-foot roadway easement for Glen Canyon Road be dedicated as a public right-of-way. A dedication will clarify the road's status and the landowner will benefit from the removal of any liability and any property taxes associated with the easement, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has Iegal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 98-123 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL tbr a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a water company office and shop building in an A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone and activities related thereto. 2. That the existing 50-foot roadway easements known as Colorado Road and Chino Drive be dedicated to the public and accepted by the Mohave County Board of Supervisors as road rights-of-way. In addition, 20-foot radius curve is required to be dedicated at the roadway intersection of Colorado Road and Chino Drive. 3. The eight feet adjoining to all rights-of-way shall be granted to the public as a Public Utility Easement (PUE). 4. All dedications and grantings may be accomplished via separate instruments. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 6. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 7. If construction or use has not conunenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 8. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
