JUAN ~C CALL~ ~OH~VE COUNTY RE.,~ J2.[TF P~6E ~ ~F 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE RESOLUTION NO. 98-124 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NORTH 1,000 FEET OF THE W¼ OF PARCEL 10, EXCLUDING THE NORTHERLY 500 FEET, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, FOR A RESIDENCE IN A C-MO/4A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Lucinda S. Vaught of Golden Valley, Arizona, and WHEREAS, this property is located south of State Highway 68, between Teddy Roosevelt Road and Laguna Road. The site is accessed from State Highway 68 via south on Glen Canyon Road to the site, located approximately 500 feet south of State Highway 68. The property has a mini-storage, a storage building, and a mobile home parked on it. The terrain is relatively flat, sloping slightly to the southeast. The surrounding land uses consist of vacant land and commercial businesses on State Highway 68. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-MO/4A (Commercial-Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 1 i, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-124 Page 2 1. This Zoning Use Pemfit is for a residence in a C-MO/4A (Commercial-Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The Section 27.P (Site Plan Requirements) must be amended to show the location of the residence, and then approved prior to approval of permits and before establishing the use. 3. That the existing 35-foot roadway easement known as Glen Canyon Road be dedicated to the public and accepted by the Mohave County Board of Supervisors as road right-of-way. 4. The eight feet adjoining to the right-of-way shall be granted to the public as a Public Utility Easement (PUE). 5. All dedications and grantings may be accomplished via separate instruments. 6. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 7. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 8. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined heroin. .~x.,xx~ MOHAVE COUNTY BOARD OF SUPERVISORS  = Carol S.
