HomeMy WebLinkAbout98-126 OFFICIAL RECORDS OF MOHAVE JOAN M{: (:ALL~ MOHAVE COUNTY 04/08/98t)2.1~F' ' RAGE i DF MOHAVE COUNTY BOARD OF SUPERV.~SORS RECORDING FEE O.l'~ RESOLUTION NO. 98-126 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF LOT 22, LAKE MOHAVE RANCHOS, UNIT 10, IN SECTION 21, TOWNSHIP 26 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-M (COMMERCIAL- MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hem-lng was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property- as requested by David L. and Deborah Boye of Dolan Springs, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road, approximately five miles northeast of the community of Dolan Springs. The site is accessed from Pierce Ferry Road, via east on Nineteenth Street to Ocotillo Road, then south on Ocotillo Road to Seventeenth Street, then east on Seventeenth Street to Palo Verde Drive, then south on Palo Verde Drive to the site, located on the west side approximately 150 feet south of Seventeenth Street. The property has a garage and shop on it and the terrain is relatively fiat, sloping slightly to the west. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WltEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on February 2, 1997 via BOS Resolution No. 97-42, and WHEREAS, this Extension of Time will allow the applicant to complete the septic system installation and the other conditions as required by BOS Resolution No. 97-42, and WHEREAS, the property owner has accomplished the following conditions of approval as required by BOS Resolution No.97-42: The applicant is in the process of completing the site plan as required by Secti.on. 27.P (Site Plan Requirements), with only the Environmental Health approval of his septic system remmmng to be accomplished, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the pamel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and ~.,.,,.~ F~ FEE::,°~' 2'' !~7 RESOLUTION NO. 98-126 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Cormnission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 97-42. 2. This Extension of Time will be in effect until February 3, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
