WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Thomas R. Christopher, R.L.S., Mohave Engineering Associates, Inc., representing MTCN Limited Partnership of Kingman, Arizona, and WHEREAS, this property is located southeast of the City of Kingman, south of Hualapai Mountain Road. The site is accessed from Hualapai Mountain Road via southwest on Lazy Y-U Drive to Tomahawk Drive, then south on Tomahawk Drive to Buckboard Trail, then east on Buckboard Trail to Stallion Drive, then south and east on Stallion Drive to the site. The property is vacant and mountainous. The surrounding land uses consist of vacant property. There are several significant drainage patterns that cross the property. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on February 5, 1996 via BOS Resolution No. 95-494. It was extended for the first time with BOS Resolution No. 97-277 on August 4, 1997. It was amended on September 2, 1997, with BOS Resolution No. 97-329 to correct a scrivener error made in the legal description, and WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as required by BOS Resolution No. 95-494. The applicant does intend to complete the rezone process in the near future, but has been delayed due to personal reasons, and WHEREAS, the property owner has not accomplished the Parcel Plat or any of the other conditions of approval as required by BOS Resolution No. 95-494, and WHEREAS, this will be the second Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and RESOLUTION NO. 98-127 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. The property has mountainous terrain and drainage ways, but does appear to have buildable sites for each lot. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 95-494. 2. This Extension of Time will be in effect until February 5, 1999. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions of BOS Resolution No. 95-494. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on Mat'ch 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
