A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 98-34
SETTING FORTH A ZONING USE PERMIT ON THE SE¼ OF SECTION 9, EXCLUDING THE
WEST 30 FEET, THE SOUTH 42 FEET AND THE EAST 42 FEET, IN TOWNSHIP 24 NORTH,
RANGE 14 WEST, FOR A PRIVATE LANDING STRIP IN AN A-R/36A (AGRICULTURAL-
RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 98-34,
setting forth a Zoning Use Permit, should be granted for the above-described property as requested by
Mohave County Public Works Department. The property owners are William W. and Lori Montgomery
of Lake Havasu City, Arizona, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been struck,
and
WHEREAS, this property is located north of State Highway 66 and east of Antares Road. The site
is accessed from State Highway 66 via north on Antares Road approximately two and three-quarters miles
to Country Road, then east on Country Road approximately two and one-half miles to Music Mountain
Road, then north-northwest on Music Mountain Road approximately one and one-eighth mile to Symphony
Drive, then east on Symphony Drive one-half miles to the property, located on the northeast comer of
Symphony Drive and Bassoon Road. The property has a single-family residence on it and is relatively flat,
sloping slightly to the southeast. The surrounding land uses consist of vacant land. There are no significant
drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, the applicant requests this Amendment to BOS Resolution No. 98-34, approving
a Zoning Use Permit, to delete the requirement for the 20-foot radius curves at the comer of
Symphony Drive and Bassoon Road, and Symphony Drive and Piano Place rights-of-way, to be
dedicated to the public and accepted by the Mohave County Board of Supervisors, and
WHEREAS, the property owner requested this Zoning Use Permit for a private landing strip in an
A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone, and
WHEREAS, a review of FEMA FIRM Panel #040058-2025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regtflations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recommended APPROVAL for an Amendment to BOS Resolution No.
98-34 setting forth a Zoning Use Permit subject to the following:
1. This Zoning Use Permit is for a private landing strip in an A-R/36A (Agricultural-
Residential/Thirty-six Acre Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable Federal Aviation Administration (FAA)
provisions and requirements.
4:. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
~. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
~ 5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
~ 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, APPROVED this Amendment to BOS Resolution No. 98-34 setting forth a
Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined
herein.
