RECOROS OF ~OH~VE COUNTY~ JO~H MC C~LL~ MOH~VE COUNTY ~' 04/08/98 02:18P PAGE I OF 2 ~~ MOHAVE C:OUNI'Y gOARD OF SUF'ERV!SORS RECORDING FEE 0~00 RESOLUTION NO. 98-131 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 94-439 WHICH APPROVED THE ZONING USE PERMIT ON THAT PORTION OF GOVERNMENT LOTS 3, 4, AND 12 OF SECTION 4, LYING NORTH AND WEST OF THE NORTHWESTERLY RIGHT-OF-WAY LINE OF INTERSTATE 40, IN TOWNSHIP 20 NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether approval should be granted for the Rescission of BOS Resolution No. 94-439 for the Zoning Use Permit for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owner is Trisha K. Spinello of Golden Valley, Arizona, and WHEREAS, this property is located west of Interstate 40 and north of the Interstate 40/McConnico Interchange. The site is accessed from Interstate 40 via the McConnico Interchange, then northwest to the Oatman Road/Interstate 40 Frontage Road, then northeast on the Frontage Road approximately 1.3 miles to the site, located on the northwest side of the Frontage Road. The property has a small building, a gravel pit, an impound lot/wrecking yard and some miscellaneous mining equipment on it. Them are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a Zoning Use Pemfit for a wrecking yard facility in an A (General) Zone by the Mohave County Board of Supervisors on December 5, 1994, via BOS Resolution No. 94-439. There were not any requests for Extensions of Time and there were no responses to the Planning and Zoning Department's inquiry concerning an Extension of Time. Another letter was sent infon~ing the property owner that it would be scheduled for rescission. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL ibr the Rescission of BOS Resolution No. 94-439 for a Zoning Use Permit, and RESOLUTION NO. 98-131 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
