RESOLUTION NO. 98-134
A RESOLUTION SETTING FORTH A REZONE OF PARCEL 44-B, AS SHOWN ON RECORD
OF SURVEY BOOK 10, PAGE 96, PEACOCK MOUNTAIN RANCHES, IN SECTION 7,
TOWNSHIP 21 NORTH, RANGE 15 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/
TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A AND A-R/7A (AGRICULTURAL-
RESIDENTIAL/FIVE ACRE AND SEVEN ACRE MINIMUM LOT SIZE) ZONES, IN THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6,
1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Robert A. Leblanc of Kingman, Arizona, representing Douglas M. and
Luanne J. Lane of Kingman, Arizona, and
WHEREAS, this property is located approximately one mile northwesterly of the DW Ranch Road
Interchange on Interstate 40. The site is accessed from the DW Ranch Road Interchange on Interstate 40
via northwesterly on Roundup Avenue to Amarillo Road, then north on Amarillo Road to Siesta Road, then
west on Siesta Road to the property, which is located on the northeast comer of Siesta Road and Arroyo
Drive. The property is vacant. The terrain is gently rolling hills and slopes slightly toward the northwest.
The surrounding land uses consist of vacant parcels and a few scattered single-family residences. There are
no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for creation of three 5-plus-acre
residential parcels. The applicant proposes to divide the 19.72-gross-acre parcel into one 7.842-gross-acre
parcel, one 6.752-gross-acre parcel, and one 5.1246-gross-acre parcel. The Mohave County General Plan
designates this area as a Rural Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this item was continued for 60 days at the January 14, 1998, Mohave County Planning
and Zoning Commission meeting to allow time for area residents to research and discuss the formation of
a general improvement district for Peacock Mountain Ranches. The applicant has not yet demonstrated that
this has been attempted or accomplished, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 11, 1998, the Commission recommended DENIAL for a Rezone based upon the following:
1. Opposition of surrounding property owners
2. Inadequate infrastructure.
3. Peacock Mountain Ranches lacks an area plan that defines specific land use acreage
designations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 6, 1998, DENIED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
