HomeMy WebLinkAbout98-138 OF'FICI~L RECORDS OF HOH~VE ,lOAN HC C~LL~ HOH~VE COUNTY RECORDER !'1~/-8/~8 02~21F' P6GE 1 OF 2 ~IOHAVE COUNTY BOARD OF o RECORDING FEE O.DO RESOLUTION NO. 98-138 A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE SOUTHERN 15 FEET OF A 50-FOOT ROADWAY EASEMENT KNOWN AS WILKS RANCH ROAD, THE WESTERN 15 FEET OF A 50-FOOT ROADWAY EASEMENT KNOWN AS PARKER STREET, THE NORTHERN 20 FEET OF A 50-FOOT ROADWAY EASEMENT KNOWN AS WINDWALKER ROAD, THE EASTERN 20 FEET OF A 50-FOOT ROADWAY EASEMENT KNOWN AS BANNISTER STREET, IN PARCEL 199, IN SECTION 25, TOWNSHIP 23 NORTH, RANGE 17 WEST IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway easements as requested by Annette M. Holmquist, representing Thomas A. and Lorraine Tinkham and David Delaney of Port Angeles, Washington, and WltEREAS, the site is located approximately one-eighth mile east of Stockton Hill Road. The site is accessed from Stockton Hill Road via east on Wilks Ranch Road approximately 740 feet to the property, Parcel 199, at the comer of Bannister Street. The roadway easements surround Parcel 199. Wilks Ranch Road is semi-improved; Bannister Street, Parker Street, and Windwalker Road are unimproved. The surrounding land uses consist of vacant parcels and widely scattered single-family residences, and WHEREAS, the owners are presently rezoning this parcel in a companion action. The owners have petitioned to remove the roadway portion of easement no longer required by the Mohave County Department of Public Works, and WHEREAS, a review of FEMA FIRM Panel #040058-2150B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and efYect complies with the Mohave County General Plan and the Long Mountain Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 98-138 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Cormnission recommended APPROVAL for the Abandonment subject to the following: 1. The conditions of the BOS Resolution rezoning Parcel 199 will be met prior to the abandonment of these portions of the roadway easements. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and March 28, 1998, and posted March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
