REOOROINfi FEE 0.00 RESOLUTION NO. 98-139 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON GOVERNMENT LOT 4, IN SECTION 6, TOWNSHIP 25 NORTH, RANGE 18 WEST, FOR A WATER STORAGE TANK IN AN A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Mt. Tipton Water Company of Dolan Springs, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road, between Eleventh Street amd Ninth Street. The site is accessed from Pierce Ferry Road via east on Eleventh Street approximately one and one- quarter miles to the site, located on the south side of Eleventh Street on land managed by the Bureau of Land Management (BLM). The property has an existing water tank on it and the terrain slopes to the northeast. The surrounding land uses consist of vacant land and a few scattered single-family residences to the west. Them are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Pem~it for a 200,000-gallon water storage tank on BLM land. This is an expansion to the existing water tank. The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs is an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. Them are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Plamfing and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 98-139 Page 2 1. This Zoning Use Permit is for a water storage tank in an A-R~36A (Agricultural- Residential/Thirty-six Acre Minimum Lot Size) zone and activities related thereto the functions of the water tank. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The water tank shall be painted an earth-tone color and will be fenced as required by the Arizona Department of Envirorrmental Quality (ADEQ). 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Plannin~ and Zoning Commission and outlined herein. .~xs.~,~'"""'"~'.,~,~/~/.
