"( RESOLUTION NO. 98-140 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1087, VALLE VISTA, UNIT TWO, TRACT 1200, IN SECTION 3, TOWNSHIP 23 NORTH, RANGE 15 WEST, FOR A MODEL HOME 1N AN R-O/10M (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED/TEN THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, 1N THE VALLE VISTA PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 6, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by George ?. and Lorraine D. Cook o£ Kingman, Arizona, and WHEREAS, this property is located northwest of State Highway 66 in the Valle Vista Subdivision. The site is accessed from State Highway 66 via northwest and north on Concho Drive to the site, located on the southeast corner of Concho Drive and Burro Drive. The property has a single-family residence on it and the terrain is relatively fiat, sloping slightly to the southwest. The sm'rounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a model home in an R-O/10M (Single Family Residential/Mobile Homes Prohibited/Ten Thousand Square Foot Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF' '2 BK 3066 f:'G 734 I:'EE~98020~[~50 RESOLUTION NO. 98-140 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 11, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a model home in an R-O/10M (Single Family Residential/ Mobile Homes Prohibited/Ten Thousand Square Foot Minimum Lot Size) zone and activities related thereto, including the selling of homes within the VALLE VISTA subdivision. No off-site sales will be allowed. 2. The house will be fully functional. When it is no longer being used as a sales office and model home, it will be reconfigured to a single-family residence and garage and will be inspected by the Mohave County Building Department for compliance with the building code. 3. The applicant shall comply with ail applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and fioodplain permits will be obtained prior to construction. 5. If construction or use has not colmnenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 21, 1998, and posted on March 20, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 6, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning ~ Commission and outlined herein.
